Contest rules on Instagram under the name “Holiday oral hygiene with ZENT®”
§1 General Provisions
- The organizer of the Contest is ZENT sp. z o.o. with its registered office at ul. Sienkiewicza 1, 39-300 Mielec, NIP: 8172214665, REGON: 527891301, registered under KRS number: 0001090270, in the 12th Commercial Division of the National Court Register of the capital city of Rzeszów, share capital amounting to 5,000 PLN, hereinafter referred to as the “Organizer”.
- The Contest is conducted under the rules described in these Terms and Conditions in accordance with the generally applicable provisions of Polish law.
- The Contest starts on 17.12.2024 and ends on 20.12.2024 at 13:00 Polish time.
§2. Participants and Contest Rules
- Participation in the Contest is voluntary and free of charge.
- A natural person (consumer within the meaning of Article 22 of the Civil Code), hereinafter referred to as the Participant, who:
- has read these Terms and Conditions, accepted their content, and consented to the processing of personal data for the purpose of conducting the Contest by submitting participation in the Contest;
- has reached 18 years of age and has full legal capacity;
- having a delivery address within the territory of the Republic of Poland,
- has a public account (profile) on Instagram,
- will complete the Competition Task.
- Only a person who meets the conditions specified in §2. section 2 of the Regulations may be a participant in the Competition.
- Employees of the Organizer and entities and employees of entities providing services to the Organizer in organizing the Competition under civil law contracts, as well as immediate family members (spouses, ascendants, descendants, and siblings) of the aforementioned persons, are excluded from participation in the Competition.
- To participate in the Contest, during its duration, the Participant must complete the Contest Task. Completing the Contest Task means posting under the contest post published on the Instagram service at the URL: https://www.instagram.com/p/DDr7rIru1Dz/?utm_source=ig_web_copy_link a comment in response to the question: “How do you take care of oral hygiene during the holidays?”
- Only participants who complete the Competition Task during the Competition will take part in the Competition.
- The participant may take part in the Competition only 1 (one) time.
- The Organizer reserves the right to remove and exclude from the Competition completed Competition Tasks whose authors:
a) do not act on their own behalf, but through third parties,
b) operate from fictitious accounts/profiles on Instagram;
c) create fictitious accounts/profiles on Instagram;
d) violate the Instagram service regulations.
e) used in the Competition Task words commonly recognized as offensive, pornographic content, content promoting hatred based on race, ethnicity, and religion or discriminating against social groups, violated the personal rights of persons or third parties or the Organizer.
§ 3 Rights to completed Competition Tasks
- The participant guarantees that the completed Competition Task will not infringe any rights or goods of the Organizer, third parties, in particular their proprietary and personal copyrights and personal rights.
- The Participant declares that they hold exclusive and unlimited copyrights to the completed Contest Task and that the completed Contest Task is not encumbered with any rights of third parties, and the work has not been previously published.
- Pursuant to Article 921 § 3 of the Civil Code, the Organizer reserves, upon awarding the Prize, the acquisition of a non-exclusive license to the Contest Task awarded in the Contest without time and territorial limitations, and the awarded Contest Participant (Winner) grants the Organizer a non-exclusive license to the awarded Contest Task on the following fields of exploitation:
- regarding the fixation and reproduction of the work - producing copies of the work by a specified technique, including printing, reprographic, magnetic recording, and digital techniques;
- regarding the distribution of the original or copies on which the work has been fixed - placing on the market, lending, or renting the original or copies;
- regarding the dissemination of the work in a manner other than specified in point b - public performance, exhibition, display, playback, as well as broadcasting and rebroadcasting, and also public making available of the work in such a way that everyone can access it at a place and time chosen by them, including introducing the work into computer memory and telecommunications and IT networks.
§4. Prizes and Selection of Winners
- To ensure the proper conduct of the Contest, the Organizer will appoint a single-member Committee hereinafter referred to as the Contest Committee. The tasks of the Contest Committee will include overseeing the proper course of the Contest, making decisions on all matters concerning the Contest, including the interpretation of the provisions of these Rules, and selecting Participants who will be awarded Prizes (hereinafter: Winners). The decisions of the Committee are final, which does not deprive the Participant of the right to pursue claims arising from legal provisions.
- After the Competition ends, the Competition Committee will evaluate the Tasks performed by the Participants and select one winner among the Participants who, in the Committee's opinion, performed the Task most attractively, originally, and creatively.
- The following prizes will be awarded to the Competition Winners:
Prize: ZENT™ Ultrasonic Cleaner
- Prizes are exempt from personal income tax under Article 21, paragraph 1, point 68 of the PIT Act.
- The Committee will complete the selection of Winners no later than on 20.12.2024
- Contest Winners will be informed about receiving the Prize by posting the list of Winners indicating the names of profiles (accounts) on the Organizer's profile on Instagram @zentcarepolska in the story and the description of the contest post, no later than 21.12.2024
- Information about winning the Competition will be sent to the Winners in a private message on Instagram.
- The condition for receiving the Prize is that the Winner provides the Organizer with the data within 14 days from the date the Organizer sends an email to the address kontakt@zentcare.pl information necessary for Prize delivery, including in particular: first name, last name, email address, and mailing address within the territory of the Republic of Poland.
- If the Winner does not provide the data necessary for Prize delivery within the deadline and under the conditions specified in section 7 above, the Competition Committee will select another Participant to receive the Prize.
- The Organizer is not responsible for failing to deliver the Prize to the Participant if the inability to deliver the Prize resulted solely from the Participant's failure to provide the data required for Prize delivery or from providing incorrect or non-compliant data with the Regulations.
- Each Prize will be sent once by the Organizer to the address indicated by the Winner within the territory of the Republic of Poland within 7 days from the day the Winner sends all data enabling the shipment of the Prize in response to the notification about the awarded Prize.
- The Prizes are funded by the Organizer.
- The Winner may not transfer the rights to the awarded prize to a third party.
- The Winner may waive the right to the awarded Prize by submitting an appropriate written statement to the Organizer.
- The Prize can only be received once in the Contest.
- The Prize will be sent to the Participant at the Organizer's expense.
- The Participant does not have the right to demand the Prize be exchanged for a cash prize.
§5. Personal Data
- The personal data administrator of the Participants is the Organizer. Contact with the organizer is possible by correspondence at the correspondence address ZENT sp. z o.o., Sienkiewicza 1, 39-300 Mielec and at the e-mail address kontakt@zentcare.pl
- The basis for processing personal data is Article 6(1)(a) of the GDPR - Participants' consent to participate in the Contest, and Article 6(1)(f) - the legitimate interest of the administrator, especially regarding complaint recognition and claim enforcement.
- Participants' personal data will be processed to the extent and for the purpose necessary to conduct the Contest, select Winners, consider any complaints, and in the case of Winners, also to notify about the Prize award and issue the Prize.
- Providing personal data is voluntary, but it is a condition for issuing Prizes to Winners or submitting complaints, in terms of identification and address data.
- Personal data will be stored for the duration of the Contest, and after its completion until the limitation period of any claims or the expiration of the obligation to store data resulting from legal provisions, no longer than 5 years from the end of the calendar year in which the Contest was conducted.
- The Organizer exercises the rights of the persons whose data is concerned, i.e. access to the content of their data and the right to rectify, delete, restrict their processing, and the right to data portability.
- In the case of processing personal data based on consent, the Participant has the right to withdraw consent at any time, and the withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. Withdrawal of consent requires electronic notification to the email address kontakt@zentcare.pl
- The recipients of the data are: entities providing hosting services, postal services, entities cooperating with the Organizer within the scope of accounting and tax services, public authorities based on and within the limits of the law, in particular such as KAS, law enforcement authorities.
- Personal data is not processed automatically and is not subject to profiling.
§ 6. Complaints
- Contest Participants have the right to submit a written complaint with the note Holiday oral hygiene with ZENT® to the e-mail address e-mail kontakt@zentcare.pl or the correspondence address of the Organizer ZENT sp. z o.o., Sienkiewicza 1, 39-300 Mielec related to the course of the Contest during its duration, as well as up to 14 days after the end of the Contest.
- The letter containing the complaint should indicate the Participant's first and last name and the correspondence address to which the response to the complaint will be sent.
- The Organizer will respond to the Participant's complaint within 14 days by registered mail sent to the address provided in the letter containing the complaint.
- A negative consideration of a Participant's complaint by the Organizer does not exclude the Participant's right to pursue claims to which they are entitled under generally applicable law, including through court proceedings.
§7. Final provisions and technical information.
- The Rules come into effect on 17.12.2024
- The Contest is not a promotional lottery within the meaning of Article 2, paragraph 1, point 9 of the Act on Games and Mutual Betting of July 29, 1992 (Journal of Laws of 2004, No. 4, item 27, as amended) and is not subject to the rules contained in the aforementioned act and executive regulations to this act.
- The Contest Organizer is not responsible for the inability of a potential Participant to submit the completed Contest Task due to reasons solely attributable to the Participant.
- The Contest Rules are made available during the Contest via the public teleinformatics network Internet at the URL address: https://www.instagram.com/p/DDr7rIru1Dz/?utm_source=ig_web_copy_link and at the Organizer's headquarters.
- The Organizer undertakes to make every effort to amicably resolve any disputes that may arise in connection with the conduct of the Contest.
- The court competent to resolve disputes is the court with local and subject-matter jurisdiction in accordance with the law.
- This Contest is in no way organized, sponsored, conducted, or endorsed by the Instagram service or affiliated with it.
- The entity solely responsible for conducting the Contest is the Organizer, and Participants agree to release the Instagram service from any liability that may arise in connection with organizing the Contest.
- Changing the Regulations requires publication and informing Participants about the changes made by the Organizer. Changes may only be made for reasons of adapting the Regulations to the applicable legal provisions.
